Mr. Manuele is a partner in Feldman Kieffer’s litigation and health care groups with a blended practice combining personal injury, corporate, and health care law. He is a graduate of Syracuse University, Niagara University, and the State University of New York at Buffalo School of Law.

Mr. Manuele has been selected in Buffalo Business First Legal Elite of Western New York. He is also recognized in Super Lawyers, Top Rated in professional liability and medical malpractice. Mr. Manuele has authored articles and given presentations on health care fraud and abuse, privacy, employment discrimination, nursing home abuse, professional counseling, and contract negotiations. He is nationally published in the Defense Research Institute For the Defense magazine.

Mr. Manuele defends clients in medical malpractice, professional liability, nursing home abuse, toxic tort, products liability, general negligence, and employment discrimination cases. He has trial experience in medical practice, products liability, and asbestos cases.

Mr. Manuele represents Absolut Care nursing home companies in class action litigation alleging violation of patient rights and negligence. Additionally, he represented Absolut Care in EEOC class action employment discrimination litigation based on gender, sex, and pregnancy disability resulting in a positive resolution for the client.

Mr. Manuele also represent various clients before administrative agencies such as the EEOC, New York State Division of Human Rights, New York State Department of Labor, and the New York State Workers’ Compensation Board.

In addition to his litigation practice, Mr. Manuele counsels health care professionals, practices, hospitals, and nursing homes on a wide range of legal issues, such as: employee discipline and termination; discrimination; privacy; fraud and abuse compliance; peer review and quality assurance; J-1 and H-1 applicant contracting; vendor agreements; employee and independent contractor agreements; restitution claims by Medicare, Medicaid, and private payers; professional licensure; and general legal compliance and inquiries unique to the health care industry. Mr. Manuele forms New York State business entities for individuals, facilities, and professionals. He prepares bylaws, operating agreements, and other governing documents for business entities. Further, he has represented business entities and individuals in sale and acquisition transactions.

Mr. Manuele is responsible for servicing large litigation and institutional clients. For the past ten years, he served as general counsel for UPMC Chautauqua, formerly known as WCA Hospital, the largest health system in Chautauqua County, New York. He represented WCA Hospital in its cross-border affiliation with University of Pittsburgh Medical Center, a nationally recognized health care company. Mr. Manuele participated in preparing and negotiating the affiliation agreement, conducting due diligence, meeting with members of the New York State Department of Health in Albany, representing WCA Hospital before the New York State Public Health and Planning Council, and working with specialty counsel and political activists.

Mr. Manuele acts as UPMC Chautauqua’s lead trial counsel prosecuting Mental Hygiene Law Article 81 Petitions for alleged incapacitated patients and applications for retention of mentally ill patients for medical treatment over their objection. He has obtained a 100% success rate on mental hygiene and guardianship petitions taken to trial.

Mr. Manuele has represented UPMC Chautauqua and its employees and officers in litigated matters. He successfully represented the Hospital’s Chief Executive Officer in a claim brought by a physician reported to the National Practitioner’s Data Bank, obtaining immunity for the CEO and Hospital under the federal Health Care Quality Improvement Act. Hooda v. W.C.A. Serv. Corp., 2013 U.S. Dist. LEXIS 71809 (U.S. Dist. Ct. W.D.N.Y.).
